1. Who we are

This website (nestrialiving.com) is operated by Nestria Living. By using this website or placing an order, you agree to be bound by these terms. Please read them carefully.

You can contact us at any time at support@nestrialiving.com. We will provide our full trading address on request.

2. Placing an order

By placing an order, you are making an offer to purchase goods from us. We will acknowledge receipt by email. A contract between us is formed when we send you a dispatch confirmation email.

We reserve the right to decline or cancel an order if:

An item becomes unavailable after your order is placed
There is a pricing or description error on the website
We are unable to verify or process your payment
We reasonably suspect fraud or misuse

If we cancel an order, we will notify you promptly and refund any payment taken in full.

3. Prices and payment

All prices are shown in pounds sterling (£) and include VAT where applicable.

We accept payment by major debit and credit cards and the digital wallets offered at checkout, processed securely through Shopify Payments. Payment is required in full at the time of ordering.

We make every effort to ensure prices are accurate. If we discover an error in the price of goods you have ordered, we will contact you before dispatch and give you the option to continue at the correct price or cancel for a full refund.

4. Delivery

We deliver to United Kingdom addresses only, and delivery is free on all orders. Please see our Delivery Information policy for full details of timescales. We cannot guarantee specific delivery dates unless expressly stated.

5. Returns and refunds

Please see our Returns & Refunds policy for full details. Your statutory rights as a consumer under UK law are not affected by these terms.

6. Your statutory consumer rights

Nothing in these terms reduces or removes your statutory rights under UK law. These include:

Your right to cancel your order within 14 days under the Consumer Contracts Regulations 2013 — we extend this to 30 days as a commercial decision
Your right to a refund, repair or replacement for faulty or misdescribed goods under the Consumer Rights Act 2015

If there is any conflict between these terms and your statutory rights, your statutory rights take precedence.

7. Product descriptions

We make every reasonable effort to ensure product descriptions, images and prices are accurate at the time of listing. Colours may appear differently depending on your screen settings, and natural materials such as wood and rattan vary in grain and tone from piece to piece. We reserve the right to correct any errors, inaccuracies or omissions.

8. Assembly and safe use

Some items require assembly. Please follow the instructions supplied, use any fixings provided, and make sure wall-mounted items are fixed securely to a suitable wall. We are not responsible for damage or injury caused by incorrect assembly or installation.

9. Your account

If you create an account, you are responsible for keeping your login details secure and for any activity that takes place under your account. Please tell us straight away if you believe your account has been used without your permission.

10. Acceptable use

You agree not to use this website for any unlawful purpose, to attempt to gain unauthorised access to it, or to interfere with its normal operation.

11. Intellectual property

All content on this website — including text, images, graphics, logos and design — is owned by or licensed to Nestria Living and is protected by UK and international copyright law. You may not reproduce, distribute or use any content without our express written permission, except for personal, non-commercial use.

12. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, consequential or special losses arising from your use of this website or purchase of our products. Our total liability for any claim is limited to the value of the relevant order.

Nothing in these terms excludes or limits our liability for:

Death or personal injury caused by our negligence
Fraud or fraudulent misrepresentation
Any other liability that cannot lawfully be excluded or limited under UK law

13. Events outside our control

We are not liable for delays or failure to perform caused by events outside our reasonable control, including carrier disruption, extreme weather or supply failures. We will let you know as soon as possible and offer a refund if we cannot fulfil your order.

15. Complaints

If something has gone wrong, please email support@nestrialiving.com with your order number and we will respond as quickly as we can.

16. Changes to these terms

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
